Terms of Service

These Terms of Service ("Terms") govern your access to and use of ennoki.com and any purchase you make from Ennoki. By browsing the site, creating an account or placing an order you accept these Terms in full. If you do not accept them, please do not use the site.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to place an order. Some products — including generators, shop machinery, tire changers, golf carts and e-bikes — may be restricted by age or by local regulation. It is your responsibility to confirm you may legally own and operate an item before purchasing.

2. Your Account

You are responsible for the accuracy of the information on your account and for keeping your password confidential. Notify us immediately at contact@ennoki.com if you suspect unauthorised use. We may suspend or close an account used for fraud, abuse or any breach of these Terms.

3. Products, Descriptions and Availability

• We work to describe every product accurately, but specifications, dimensions, weights, colours and included accessories are supplied by manufacturers and may change without notice.
• Photographs are illustrative. Accessories, tools, décor or plants shown alongside a product are not included unless expressly listed.
• All products are subject to availability. Stock can sell out between your order being placed and being picked.
• We reserve the right to limit quantities, refuse an order, or discontinue any product at any time.

4. Pricing and Errors

Prices are shown in US dollars and exclude sales tax and any shipping surcharge unless stated. Despite our best efforts, a product may occasionally be listed at an incorrect price. Where a price is obviously wrong, we may cancel the order and refund you in full, even after payment has been taken. See our Billing Policy for details.

5. Orders and Acceptance

Your order is an offer to buy. A confirmation email acknowledges receipt but does not constitute acceptance. The contract is formed when we dispatch the goods or, for freight items, when we confirm a delivery appointment. We may decline an order for reasons including stock, suspected fraud, a delivery address we cannot service, or a pricing error.

7. Intellectual Property

The Ennoki name, logo, site design, original copy and page layouts are owned by or licensed to us and are protected by US and international law. Manufacturer names, model numbers and trademarks remain the property of their owners and are used only to identify the products we sell. You may not copy, scrape, republish or use our content commercially without written permission.

8. Acceptable Use

You agree not to:

• use the site for any unlawful purpose or in breach of any regulation;
• submit false, fraudulent or stolen payment details;
• scrape, crawl or harvest data, pricing or images by automated means;
• attempt to probe, penetrate or disrupt the site, its servers or its security;
• upload malicious code, spam, or content that is abusive, defamatory or infringing;
• resell products acquired from us as new-in-box authorised stock without our written agreement.

9. User Content

If you post a review, question or image, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display it in connection with our business. You confirm the content is yours to share and is not unlawful. We may remove any submission at our discretion.

10. Disclaimer of Warranties

The site is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or free of harmful components. Products carry only the manufacturer warranty described on our Warranty Policy page. 11. Limitation of Liability

To the maximum extent permitted by law, Ennoki and its officers, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising from your use of the site or any product purchased. Our total aggregate liability for any claim is limited to the amount you paid for the product giving rise to that claim. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Ennoki against any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the site, or your negligent or unlawful use of a product purchased from us.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. You and Ennoki agree that the state and federal courts located in Texas have exclusive jurisdiction over any dispute, and you waive any objection to venue there. Before filing a claim, please contact us at contact@ennoki.com — most matters are resolved quickly and informally.

14. Force Majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including severe weather, carrier disruption, port congestion, strikes, supplier failure, utility or network outages, fire, flood, or acts of government.

15. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce a right is not a waiver of that right.

16. Changes to These Terms

We may revise these Terms at any time. The version published on this page at the moment you place an order is the version that applies to that order.
